Introduction The Privilege programme is operated by Delta Air Transport NV, trading as Brussels Airlines, a company incorporated in Belgium, with registered office at Koloniënstraat (rue des Colonies) 11, 1000 Brussels. Privilege is a registered word and device mark.
Access to the offers and benefits of the Privilege Programme (hereinafter referred to as the Programme) is available to members upon acceptance of the present terms and conditions of the Programme. The Programme and any subsequent amendments to the Programme may be consulted by visiting the Brussels Airlines website at brusselsairlines.com (the 'Website'). At any time during their membership, members may request a copy of the current Programme by letter, e-mail, fax or telephone (for details call your Privilege Service Centre). Access to the offers and benefits of the Programme is strictly limited to those members who have accepted the present terms and conditions of the Programme. Benefits granted under the Programme are not transferable.

Eligibility for membership Privilege membership is subject to receipt by Brussels Airlines of a membership application (via a written application form or an online application form available from the Website) and acceptance of the membership by Brussels Airlines.
Privilege membership is available for individuals of two years or older with residence in a country in which frequent flyer programme membership is legally permitted.
Privilege membership is not available for legal entities, groups or associations. Multiple membership is not permitted.
Privilege Gold and Privilege Platinum membership may be granted to certain members subject to compliance with the terms and conditions of the Programme applicable at that moment.

Privilege membership number and membership card To receive offers and benefits from the Programme, the membership card and/or membership number is required.
The members will receive a membership card after completion of 1 flight as a Privilege programme member with Brussels Airlines or a Privilege partner airline company. The list of Privilege partner airline companies can be amended from time to time.
Brussels Airlines may provide the members with a temporary confirmation of membership prior to the issuance of Privilege membership cards.
The Privilege membership card is personal and not transferable. All Privilege membership cards remain the property of Brussels Airlines and may not be used after the expiry date and/or termination of the Privilege membership.
Lost, stolen and damaged Privilege Gold and Privilege Platinum cards may be replaced free of charge after notification to the Privilege Service Centre. Members may be charged for the replacement of subsequent cards in the event of loss, theft or damage.

Programme miles Miles credited to members under the terms of the Programme may be redeemed against bookings for subsequent flights or as payment for other services. The granting of these miles is subject to continuation of the Programme. Bonus points or miles from other loyalty programmes may be converted into Programme miles if and only if Brussels Airlines has concluded a written agreement to this effect with the operators of the loyalty programmes concerned.
Miles account: Each member has his/her personal Privilege miles account, to which the miles earned by the member will be credited and subsequently debited when redeemed by the member. Members who consented to receive the bi-monthly Privilege E-newsletter, shall be entitled to receive this E-newsletter (showing their current miles balance and other information on the Programme), subject to having earned or redeemed miles during the period to which the statement relates. Members may also consult their miles account by visiting the Website and entering their PIN.
How miles are credited: Once membership is confirmed, members may claim Programme miles when travelling on a flight with Brussels Airlines or a Privilege partner airline or paying for a service supplied by selected Programme partners, subject to eligibility of the flight or service under the Programme and to the present terms and conditions. Brussels Airlines shall determine the type and number of miles ascribed to each delivered service. Brussels Airlines reserves the right to restrict special offers to specific groups of members. Members will be informed of offers by various means such as e-mail and/or the Website. Miles in respect of services supplied by selected Programme partners will be credited exclusively subject to the terms and conditions of booking, payment and usage of such services as specified by the Programme partners. Brussels Airlines may not be held liable for the consequences of miles not being credited to a member's personal account.
No miles will be credited in respect of:
Flights or other services paid for with Programme miles or booked under the terms of special offers or benefits;
Airline employees, travel agents and/or tour operators travelling on a non-revenue or travel industry discounted fares;
Complimentary tickets provided by Brussels Airlines;
Escort tickets for the carriage of inad/anad passengers.
Validity and extension of miles credited: Unless otherwise specified in the Programme or at the time of credit, Programme miles shall be valid for three years from the date on which they are credited. The validity of the miles is calculated as from the date of their credit, i.e. the date on which the member checks in at the appropriate check-in facility for miles earned in respect of flights or the first or last day of use of a service supplied by a selected Programme partner at the place where that service is used. Members may extend the validity of miles credited to their personal accounts by the payment of a fee prior to their expiry date, paid exclusively by credit card.

Offers and benefits Booking or ordering of offers and benefits Details of current offers and benefits are available on the Website, in relevant mailings and via the Privilege Service Centre. Privilege partner airlines and other Programme partners may specify predetermined terms and conditions for the booking or ordering of offers and benefits. Such predetermined terms and conditions may vary with respect to specific offers and benefits.
When booking or ordering an offer or benefit with a Programme partner, a member enters into a contractual relationship with the individual provider of the offer or benefit. Each offer or benefit shall be subject to the booking agreement and terms and conditions specified by the provider of the offer or benefit and applicable to the relationship between this provider and the member. Members do not enter into any contractual relationship with Brussels Airlines when booking or ordering an offer or benefit with a Programme partner. Brussels Airlines declines any liability for the proper performance of services supplied or for the suitability for specific purposes or the quality of goods supplied by third parties as offers and/or benefits.
Privilege members shall be responsible for the payment of any taxes and/or duties or inconveniences to which they may be subject in respect of the redemption of Programme miles or Programme offers and benefits.
Members must specify that they are booking or ordering an offer or benefit prior to making the booking or placing the order for an offer or benefit. Normal bookings and orders may not be converted into bookings and orders for offers and benefits. Brussels Airlines and its Programme partners reserve the right to decline to supply an offer or benefit if the member has already booked a flight or ordered a service without indicating clearly that the booking or order concerned relates to a Privilege offer or benefit. Offers obtained illegally or in contravention of these terms and conditions shall be null and void.
Offers and benefits supplied may not be transferred, replaced, extended or otherwise amended or refunded unless otherwise specifically stated in the booking agreement or terms and conditions of Brussels Airlines, the Privilege partner airline and the Programme partner. In cases where offers or benefits are allowed to be replaced, extended or otherwise amended, the member shall pay an administration charge.
Awards and benefits may be assigned to a third person, yet only at issuance thereof. Such assignment is only valid if the member does not receive any consideration in return.

Privacy and data protection Brussels Airlines is committed to protecting your privacy. The processing of any personal data collected for the Programme is done solely in accordance with the Privilege Privacy Policy.

Internet services/access to Privilege Members’ miles accounts via the Website Members who provided Brussels Airlines with their e-mail address on the membership application form, will receive a PIN code (by e-mail only) to have access to their personal Privilege account via the Website. Members may change their personal PIN at brusselsairlines.com. Within the framework of the Programme, Brussels Airlines may offer members other Internet services.
Brussels Airlines reserves the right to change the content of its Website at any time without notice.
For the purposes of providing members with Internet access to their personal Privilege account and to other internet-based services offered under the Programme, Brussels Airlines and its partners and suppliers shall rely upon the input of two items only, being the membership number and personal PIN, to confirm a member’s identity. Members may choose their personal PIN at brusselsairlines.com or have one allocated to them by calling the Privilege Service Centre. The members may not communicate their personal account number and personal identification number (PIN) nor place at the disposal of third parties, i.e. family members, employees and colleagues. Members shall be personally liable for all transactions and/or acts of negligence, which may be carried out using their account number or PIN.
Brussels Airlines draws your attention to the fact that any use of the Website is subject to the Terms of use of the website.

Privilege telephone services For the purposes of providing members with access to Privilege telephone services offered under the Programme, Brussels Airlines and its partners and suppliers shall rely upon the input of two items only, being the membership number and personal PIN, to confirm a member’s identity. Members may choose their personal PIN at brusselsairlines.com or have one allocated to them by calling the Privilege Service Centre. Members may not communicate nor make available their account number or personal identification number (PIN) to third parties, including family members, employees and colleagues. Members shall be personally liable for all transactions and/or acts of negligence which may be carried out using their account number or PIN. Brussels Airlines and its suppliers shall make telephone services available to members without any guarantee or condition, whether explicit, implicit or prescribed by law.
By using the Brussels Airlines telephone services, members agree that Brussels Airlines and its suppliers are entitled to record the telephone conversations for quality control, quality improvement and training purposes.
Brussels Airlines and its suppliers undertake not to disclose the contents of these conversations and not to use them for other purposes than the ones foreseen hereunder.
9.
Miscellaneous Members shall be personally responsible for fully informing third parties, companies (e.g. their employers) and government bodies of their membership of the Programme and of the offers and benefits available to them under the terms of the Programme. Privilege grants miles only to members and cannot be held liable in respect of agreements between members and third parties (e.g. employers).
Local legislation in certain countries may impose restrictions upon members and/or the terms and conditions of the Programme. Brussels Airlines, Privilege partner airlines and Programme partners reserve the right to take whatever measures that may be necessary to ensure compliance with such restrictions and may not be held liable for any prejudice suffered by members as a result of such measures.
Brussels Airlines reserves the right to assign the management of the Programme to its successors or to one or more third parties and to transfer agreements with members of the Programme for this purpose to such successors or to one or more third parties.
If any provision of these terms and conditions shall become or be declared unlawful, void, or for any reason unenforceable, such provision shall be deemed severable from these terms and conditions and shall not affect the validity and enforceability of any remaining provisions.
10.
Termination of Privilege membership Membership shall be terminated automatically in the event of termination of the Programme.
Brussels Airlines may terminate Privilege membership with immediate effect:
If the concerned member fails to comply with these terms and conditions and/or documents to which these terms and conditions apply by reference;
If the concerned member attempts to obtain or has obtained the benefits of the Programme by providing false information or by any other inappropriate or fraudulent manner;
If the concerned member fails to comply with the general conditions of carriage of Brussels Airlines and any other applicable rules and regulations;
If the concerned member fails to respect the code of conduct on board of an aircraft of Brussels Airlines, of a company with which Brussels Airlines has a code-share agreement or a Privilege airline partner;
If the member concerned fails to use his or her card at least once in three years.
In the cases mentioned in the previous paragraph, the outstanding miles of the concerned member expire with immediate effect.
Any member attempting to obtain or having obtained the benefits of the Programme by providing false information or by any other inappropriate or fraudulent manner shall be liable for any prejudice resulting from such acts.
Privilege members may terminate their membership of the Programme at any time and without prior notice by letter, fax or e-mail (for details call your Privilege Service Centre). Any outstanding miles on his/her name shall be cancelled upon termination of their membership if no reasons are given or for reasons other than a proven failure by Brussels Airlines to comply with any of its obligations by virtue of the present terms and conditions.
11.
Applicable law – competent courts The present terms and conditions are subject to Belgian law, without giving effect to any principles of conflicts of law.
Any dispute shall be submitted to the Brussels courts, which shall have sole jurisdiction.
